This is exactly what happened to the total garbage hayride trailer in Maine....why no action?  Profit is more important then saving lives to these cheap farmers who conduct unsafe hayrides and who have chosen to lobby against us.

This New Law Will Be Un Enforceable when they allow "Free Unsafe Never Inspected Hayrides"  These Farmers are really good writing bills....But I am better than they are...because I know how to read bills and make laws.  That is why they have never contacted me because I know what is needed to save lives.
What ever law they pass I will point out each and every loophole they have created by the lobbiest of these cheap farmers who believe they can conduct unsafe hayrides just like in Virginia.

‘Cassidy’s Law’ aims to tighten Maine’s amusement ride safety laws

AUGUSTA, Maine — A hayride mishap that claimed the life of a 17-year-old Oakland girl last October at a farm in Mechanic Falls has Maine lawmakers grappling with what the state can or should do to prevent similar tragedies in the future.

On Monday, the Legislature’s Criminal Justice and Public Safety Committee heard testimony from Rep. Bob Nutting, R-Oakland, who said he didn’t have all the answers but knows something should be done to protect the safety of those who pay money to go on any type of amusement ride in Maine — including hayrides.

“Haunted or otherwise,” Nutting said.

Nutting is sponsoring LD 1057, a bill in response to the death of Cassidy Charette, a Messalonskee High School junior who died as a result of injuries she suffered in October. A 1979 Jeep hauling a trailer with at least two dozen people on it went off the trail and into a group of trees at Harvest Hill Farm’s Gauntlet Haunted Hayride in October 2014. Another 22 people were injured in the rollover.

Nutting said he doesn’t intend his law to be applied to anybody who offers a free ride on their farm equipment and gave the example of an apple farmer who may offer free rides to the orchard for visitors coming to pick apples. He said the bill is meant for those who charge for rides.

“When someone pays to get on a hayride or any other amusement ride, they should be able to have the reasonable expectation that somebody with expertise has inspected the ride and judged it to be safe,” Nutting said. “Nobody who paid to ride last October was able to have that expectation. The tragic loss of Cassidy Charette’s life may have been what it took to make things safer for all who look for a little fun and a little scare on an amusement ride.”

While most vehicles driven on public roads in Maine require an annual safety inspection and sticker documenting it, most farm vehicles, including farming tractors and trailers, are exempt from that requirement.

Nutting said many of his constituents feel the state needs a law to address the issue.

“And they have come to refer to it as Cassidy’s law,” Nutting said.

Under Nutting’s proposal, hayrides would be inspected and permitted much the way other mechanical amusement rides are. The state fire marshal’s office currently permits and inspects the rides operated at carnivals, fairs and amusement parks like Funtown-Splashtown in Saco.

Nutting’s bill doesn’t say which state agency should regulate hayrides, but Maine State Fire Marshal Joe Thomas said Thursday his agency was ill-equipped and unprepared to take on the regulation of hayrides.

Thomas said his office spends about $20,000 per year to keep investigators up to speed on mechanical amusement ride regulation and that adding hayrides to their responsibilities would mean additional training and likely additional staff.

“I’ve got to send them somewhere to get them trained. They have absolutely no expertise at all right now,” Thomas said.

Thomas also said his agency, which led the investigation on the Mechanic Falls mishap last year, did so because it was the only state agency that had any legal “authority even close to having a nexus connected to this incident.”

Thomas said that is because state law says the agency regulates amusement rides that travel over a “predetermined course.”

“It had absolutely nothing to do with the vehicle itself or the ride aspect of it,” Thomas said.

Thomas said in their investigation they cooperated closely with the state police and all of their findings have been left in the hands of the Androscoggin County district attorney’s office, which last said its investigation remained ongoing.

Nutting and others suggested regulating hayrides may be better handled by either the state police’s Commercial Vehicle Enforcement division or by state-authorized motor vehicle inspection stations. Those entities have expertise in motor vehicle safety inspections, Nutting said.

Thomas said his preliminary research suggests that there are more than 90 hayride-type operations in Maine each year. He also said there is a wide variety of vehicles, wagons and trailers that are used. He said some operators simply place bales of hay for seats on trailers while others have wagons that are fitted with passenger seating.

Thomas said those trailers are pulled by tractors, four-wheel drive vehicles and frequently horses.

He said an informal survey of a handful of hayride operators revealed a wide range of practices being deployed as well. He said in one instance a hayride operator said he would use as many as five different vehicles to pull different hayride trailers when demand at his farm warranted it.

The cost of developing a permitting and inspection regime for farm yard hayrides would be substantial, Thomas said, noting he would bring more information for the committee when it started its deliberation on the bill in the days ahead.

“The other thing I’m going to bring is one heck of a fiscal note,” Thomas said.

But lawmakers on the committee seemed undeterred and suggested that any new costs would have to be offset with permitting fees for those who want to operate hayrides on their farms or properties.

ROCK HILL, N.Y. -- An Upstate New York woman has died after falling off the back of a flat-bed float on a pickup truck and getting run over by a trailer it was pulling during a St. Patrick's Day parade.

The accident occurred as Susan McCormick, 56, of Rock Hill was standing in the bed of the pickup around 1:20 p.m. Saturday, according to New York State Police. The truck's driver was talking to someone in the parking lot of a gas station on Glenn Wild Road in Rock Hill, 75 miles northwest of New York City in Sullivan County.

She lost her balance and fell backward over the tailgate when the truck's driver, Bjorn Egenes, 25, of Rock Hill, pulled forward.

McCormick was run over by a trailer carrying a backhoe, police said. The Sullivan County coroner pronounced McCormick dead at the scene.

Police said its investigation into the incident was continuing.

McCormick's husband is a Rock Hill firefighter, the Middletown Times-Herald reportedThe fire department's Facebook page acknowledged "a tragic loss to our family" and asked for prayers for those involved.

Parade Deaths Prompt Safety Recommendations for Localities

Some governments lack clear planning procedures and rules for parades. Read how localities can better prepare, along with a summary of recent parade accidents.

An 8-year-old boy lost his life this summer when a Fourth of July parade float driven by his father ran him over in Edmond, Okla., during the city’s annual LibertyFest event. Later that evening, a 7-year-old boy died after suffering injuries in a similar parade float accident in Annapolis, Md. Yet another fatality occurred that day in Bangor, Maine, when a fire truck in a parade hit a man driving an antique farm tractor.

While parade accidents are generally rare, the three fatal incidents underscore the potential dangers accompanying such events.

As communities across the country hold holiday parades this time of year, the National Transportation Safety Board (NTSB) is calling for localities to adopt more stringent safety measures. The agency issued several recommendations in a November report that found governments and sponsoring entities often lack adequate planning procedures and clear rules for parades.

The most notable recommendation for localities in the NTSB report, which evaluated a 2012 Veterans Day crash in Midland, Texas, calls for governments to require written safety plans as part of an event approval process. At a minimum, NTSB states, the plan should address risk mitigation and contingency planning, safety briefings, driver and vehicle screening, float safety and notifying railroads or other entities about potential hazards.

“We want to really get organizations and communities that want to do parades to think about the risks ahead of time so that they can be managed,” said Robert Molloy, deputy director of the NTSB’s Office of Highway Safety.

Some of the more common parade hazards include participants falling off floats or performers being run over. Children running out into streets to retrieve candy also pose safety risks, Molloy said.

In the Midland report, NTSB reviewed policies from a sample of nine municipalities and universities, finding wide variation in parade operating rules and procedures.

Of the nine reviewed, only the city of Dallas required event organizers to submit a route plan for approval. Most policies also didn’t address driver communication, walking support and speed limits. Two cities and two schools prohibited objects being thrown from floats, while the other five lacked such rules.

The following table, compiled in the NTSB report, summarizes parade policies for Baylor University, the Cosumnes Community Services District Fire Department (Calif.), Dallas, Colorado State University, Florida Atlantic University, Arlington (Texas), San Diego, Fremont (Calif.) and New Mexico State University:

Without clear guidelines and rules, communication can break down.

The Midland crash occurred when a Union Pacific train collided with a float carrying veterans and their wives, killing four people and injuring 12 others. NTSB identified the probable cause as the failure of the city and parade organizer, Show of Support Military Hunt, Inc., to address the risks of routing the parade through a railroad crossing.

In previous years, a city police lieutenant had placed officers at crossings to monitor trains, or he notified the railroad of the parade so it could either slow trains or temporarily stop traffic. When the police lieutenant retired before the 2012 parade, no one notified the railroad or posted officers at crossings with the specific responsibility of monitoring oncoming trains, according to the NTSB report.

“It was informally planned, so they couldn’t take into account all the possible hazards that could occur in their parade,” said Rafael Marshall, a senior project manager with NTSB.

At the time of the accident, Midland did not require organizers to notify railroads when parade routes traversed railroad crossings. NTSB also faulted the city for failing to enforce its parade ordinances by allowing the event to take place without a permit for four years.

Midland City Council later modified its parade ordinance. Now, special events with routes crossing railroad tracks must obtain permits from city council only after submitting proof of permission from railroad officials.

For events held on an annual basis, not much might change from year to year. Requiring a written safety plan reduces the likelihood that planning will become lax, Marshall said.

NTSB also requested that the National League of Cities, National Association of Counties, National Association of Towns and Townships, U.S. Conference of Mayors and International City/County Management Association encourage their members to require written safety plans as part of parade approval processes.

ICMA is currently working with NTSB to develop a list of best practices for parades.

Christina Barberot, an ICMA public policy coordinator, said most of the municipalities she is working with are prepared and have plans in place, but there is currently not much standardization specific to parade policies. She expects to publish a report in early 2014.

At least 20 killed after power line falls on Haiti carnival float

At least 20 people were killed in Haiti’s capital Tuesday when they were electrocuted by a power line that fell on a music group's packed Carnival float, officials say.

The accident occurred as thousands of people filled the streets of downtown Port-au-Prince for the raucous annual celebration. People at the scene said someone on the float used a pole or stick to move a power line so the float could pass under it.

At least 20 people were killed and 46 were injured, according to Nadia Lochard, a coordinator for the Department of Civil Protection.

The float was sponsored by the Haitian hip-hop group Barikad Crew and caught fire in the incident, witnesses said.

Video of the incident appeared to show the electric cable hitting the head of a singer in the group near the parade’s presidential stand, which was packed with spectators, Reuters reports.

Some of the victims were instantly electrocuted in a flash of sparks, according to witnesses. Others managed to jump off, causing panic in the crowd.

"I saw the wire falling and sparks and I started running for my life," said Natacha Saint Fleur, a 22-year-old who was near the float at the time.

Hundreds of people thronged the General Hospital, where many of the victims were taken, some carrying victims and others searching for family members brought by ambulance.

In a Twitter message, Haitian President Michel Martelly expressed his "sincerest sympathies" to the victims, while his wife visited hospitals that were treating the injured, Reuters reports.

The annual street parade coincides with similar Mardi Gras carnivals around the world and attracts large crowds who watch competing musical acts atop decorated floats.

In contrast, Ron Melancon, parade safety advocate, thinks that the accident was not caused by UP, but rather the city of Midland. Melancon said the city did not ask for or require proof of insurance for the parade, and the city did not require a parade permit.

“I blame the incompetent leadership of this city (of Midland) who allowed this event to take place without our suggested parade safety standards,” Melancon said. “Shame on everybody who allowed this to happen.”

On his paradesafety.org website, Melancon calls for a “national standard” for parades so that deaths are prevented.

An attorney who spent the past two years representing veterans and spouses affected by the Nov. 15, 2012, parade and train wreck is predicting a favorable outcome for the remaining plaintiffs in the lawsuit if it moves to an appeals court.

Kevin Glasheen, an attorney for 26 of 43 plaintiffs in the train wreck lawsuit reached a settlement with defendant Union Pacific Railroad Co. on Jan. 16. He spoke with the Reporter-Telegram in an analyst capacity this past week, discussing how he thinks the next step of the lawsuit will turn out, now that he is no longer part of the case.

The jury trial is on the verge of an end in favor of UP, as previously reported.

The remaining plaintiffs still in the lawsuit -- widows and surviving family members of three deceased veterans -- plan to bring the case to the 11th Court of Appeals in Eastland and attempt to reverse all the claims against UP that presiding Judge James Rush threw out in the weeks before the trial.

"If you ask me, what do I think the chances that this get reversed on appeal and sent back for a trial on these issues, I think the chances are better than 90 percent," Glasheen said.

Glasheen based his prediction on the differences between a district court and an appeals court. District courts have a large caseload which usually do not involve complicated questions of law, while a court of appeals will have more staff and its judges are more “academic” minded, meaning they also do schorlarly research papers, he said.

For this case though, Glasheen did not discount the other 10 percent or less.

"He (Rush) may end up being right in appeal," Glasheen said. "Just because I think he's wrong doesn't mean that I'm right."

Glasheen also did not rule out the possibility that this case is capable of moving up to the Texas Supreme Court and even the U.S. Supreme Court.

For now, plaintiffs and defendants filed final responses the past week, in anticipation of the end of the trial in favor of UP, which is expected this week.

In the journey leading up to the end of the trial in Midland, the trial week consisted of two days of jury selection from a pool of 80 people and two days of actual proceedings before an abrupt and confusing end.

The first day of proceedings, on Jan. 28, had the opening statements from both sides, which previewed how the plaintiffs were going to argue about the actions of the train crew that was a part of the crash, and the defendants were going to argue that other parties, namely Midland Police Department, Midland County Sheriff’s Office, parade organizer Show of Support, tractor-trailer donor Smith Industries and tractor-trailer drivers James Atchison and Dale Hayden, were responsible for the train crash, not UP.

The plaintiffs also used opening statements to profile three of the four veterans who died from the train crash: U.S. Marine Corps Chief Warrant Officer Gary Stouffer, U.S. Army Sgt. Maj. William Lubbers and retied U.S. Army Sgt. Maj. Lawrence Boivin. All three men sustained injuries while serving their country, hence their selection for the Hunt For Heroes festivities. Widows Catherine Stouffer, Tiffanie Lubbers and Angela Boivin could not contain their sorrow at times during the trial, crying and leaving the courtroom.

The trial seemed to be on track for the weeks-long pace, as plaintiffs called railroad consultant Colin Fulk as its second witness in the mid-afternoon of Jan. 28. But right as Fulk was going to answer questions about video of the crash from a train camera, defendants objected.

The conflict was the legitimacy of the plaintiff’s one claim in the trial, which was that the UP crew onboard the train was negligent because it did not apply brakes early enough as it approached the Garfield Street railroad crossing. The plaintiffs pointed out was that the train engineer, Simon Terrazas, said “look at that idiot” as the first tractor-trailer passed the crossing. Sometime in the evening, Rush threw out the claim, therefore eliminating the plaintiffs’ chances of winning the trial.

On the morning of Jan. 29, plaintiffs called for a mistrial, noting that the case is going to be appealed by either side anyways no matter the outcome. The trial went on break for most of the day as attorneys on both sides met privately. By 4 p.m., some of the plaintiffs and defendant attorneys met with Rush in the judge’s chambers of the 441st District courtroom. It was inside there that Rush said he is going to dismiss all the issues of the case before the jury.

Closing arguments were never made to the jury. The 12 jurors chosen for the trial were dismissed and attorneys packed up all their items and vacated the courtroom.

Analyzing the strength of the plaintiff’s single claim for the trial, Glasheen said it was “ a weaker claim and not a good issue to try.”

“The best argument, the short warning time,” Glasheen said, “was thrown out weeks before the trial.”

In contrast, Ron Melancon, parade safety advocate, thinks that the accident was not caused by UP, but rather the city of Midland. Melancon said the city did not ask for or require proof of insurance for the parade, and the city did not require a parade permit.

“I blame the incompetent leadership of this city (of Midland) who allowed this event to take place without our suggested parade safety standards,” Melancon said. “Shame on everybody who allowed this to happen.”

On Nov. 15, 2012, a UP train crashed into a tractor-trailer that doubled as a parade float with 12 veterans and 12 spouses onboard. Four veterans died and 14 other people were injured as a result of the crash. A lawsuit was filed two weeks later.

The case went through several ordeals the past two years, including venue change arguments, case consolidations and presiding judge recusals.

Though the settlement is going through final agreements and adjustments, the amount to be given to the veterans, spouses and family members will not be disclosed. Glasheen said his clients in this case will be “able to live comfortably for the rest of their lives.”

While Glasheen works on the settlement, he reflected on this lawsuit’s impact on his career, saying it was a “huge case.”

"It's a very important case, one of the most important cases in my career because of the scope and the harm that was done, the magnitude of the damages was just incredible," Glasheen said. "These veterans are heroes, and deserve the best from our justice system. Getting to work with Bob Pottroff, arguably the best railroad lawyer in the country, is certainly a highlight of my career."

UPDATE: Woman Dies, Multiple people injured in haunted hayride accident


UPDATE: MECHANIC FALLS, Maine (NEWS CENTER) -- According to a family friend, a woman who was Lifeflighted to CMMC has passed away.

A hayride flipped over in Mechanic Falls Saturday night, leaving 23 people, including the driver of the hayride, injured.

The incident happened during a Gauntlet Haunted Hayride at Harvest Hill Farms on Rt. 26.

12-13 People were transported to the hospital. A few more drove themselves to the hospital, and CMMC has 17 patients total.

Saturday night officials were evaluating a number of patients and said some may have to go into surgery.

St. Mary's hospital in Lewiston also has 12 patients.

Another person was also transported by Lifeflight.

Officials say they believe there were about 30 people on the ride during the crash.

Sheriff: 1 Killed In Chippewa County Hayride Accident

MINNEAPOLIS (WCCO) – One person died Saturday night in an accident on a hayride in western Minnesota, according to the Chippewa County Sheriff’s Office.

Authorities were called to a report of a personal injury accident on 120th Avenue, about a half mile south of Highway 40 in Woods Township at about 7:46 p.m. When officers arrived, an investigation showed a group of people were out on a hayride for a birthday party.

A tractor was pulling two hay racks that were joined together when a person tried to make it from the first hay rack to the second. Authorities said the person fell between the two hay racks and was run over by the second hay rack.

The victim was pronounced dead at the scene. The accident is still under investigation, and the victim has not been identified.






We Warned the NTSB a full year before this accident that NOBODY in the Nation has a Unified Parade Float Safety Checklist or STANDARD.  They did not listen.  We know what is needed!
All we need is somebody to believe us and fund us.  The total ignorance of noting being done has resulted in over 500 injured and at least 30 deaths this year by the same unsafe Hayride / Parade accidents.

9:11 a.m. - THE BENEFITS OF A SAFETY PLAN FOR THE MIDLAND ACCIDENT COULD HAVE HELPED IN THREE AREAS.FIRST, IF THE DRIVER HAD BEEN GIVEN A ROUTE LAN OR A CHECK LIST WHICH INCLUDED THE CROSSING, HE WOULD HAVE KNOWN MORE ABOUT THIS CROSSING AND THAT IT WAS NOT CLOSED OR CONTROLLED BY OTHER MEANS. SECOND, A DEDICATED SPOTTER COULD HAVE HELPED WITH EITHER THE RESPONSIBILITY TO MONITOR PASSENGERS OR TO MONITOR THE PATH OF THE FLOAT. LAST, A MEANS OF COMMUNICATION OR OTHER WARNING DEVICES COULD HAVE PROVIDED ADDITIONAL TIME OR TO PERCEIVE AND REACT TO THE SITUATION.


9:10 a.m. - AS STATED EARLIER, MIDLAND DID NOT HAVE A SAFETY PLAN SO WE LOOKED TO SEE WHAT THEY MIGHT HAVE DONE AND WHAT RESOURCES WERE AVAILABLE FOR CREATING A SAFETY PLAN. 


9:07 a.m. THE INVESTIGATION FOUND THAT SHOW OF SUPPORT FAILED TO ADDRESS COMMON SAFETY PRACTICES THAT ULTIMATELY LED TO THE COLLISION. THIS COULD HAVE BEEN PREVENTED IF ORGANIZERS HAD CREATED AND IMPLEMENTED A WRITTEN SAFETY PLAN.


9:06 a.m. NTSB says from 2004 to 2008, Show of Support obtained parade permits from MPD. From 2009 to 2012, only one permit was obtained.

Boy airlifted to hospital in Winnipeg after being injured by a parade float

 
 
 

WINKLER, Man. - A young Manitoba boy has been airlifted to hospital in Winnipeg after officials say he was injured by a parade float.

Const. Rick Wolfe with the Winkler Police Service says the boy was between five and ten-years-old and had been part of the float crew at the annual Winkler Heritage Festival parade on Saturday.

Wolfe says the boy was from the Winkler area and was listed in stable condition after the incident.

STARS Air Ambulance spokesman Colin Fast says it appears the boy was on the float at one point, but may have gotten off to either accept, or give out, candy.

Fast says he was run over by the float that was being pulled on a seven-metre trailer.

Last weekend, Rueshad Grant, 18, died when police say he was run over while standing by a parade float in Toronto's Caribbean Carnival.

A boy also last month died after being run over by a float at the end of a Fourth of July parade in Oklahoma.

In July 2012, an eight-year-old boy died after being run over by a float in a parade celebrating the centennial of Preeceville, Sask.




We are simply heartbroken yet again of another TEENAGER KILLED BY A UNSAFE CORPORATE SPONSORED PARADE.

This Company Needs To Be Sued For Allowing This Death!!!  We Warned Everybody including the Premier of Onterio years ago....and they all make promises....but nobody ever finds the way to send us the funds to SAVE LIVES.  Now this bank has a choice....COVER IT UP.....OR HELP PREVENT OTHERS FROM GETTING KILLED EXACTLY LIKE THIS PARENTS CHILD.

This was a FAMILY'S CHILD.....Why did nobody consider PARADE SAFETY?  If This HAPPENED IN WORLD DISNEY WORLD...the media would be all over it.

If This was a defective ROLLER COASTER IN TEXAS...ONE LIFE...LOST the media went crazy over the unsafe ride.

But... in July two Children...dead in the United States...and the first week of August one dead in Canada....and all we get is no action from Canada and the United States Government.

Tell that to the family of Mr. Grant....WE AT DANGEROUS TRAILERS AND PARADE SAFETY FEELS THAT HIS LIFE DID MATTER AND WE WILL POINT THE FINGER AT THE COMPANY AND GOVERNMENT THAT IS RESPONSIBLE.

The Teenager was struck next to the trailer!  A SAFE ZONE NEEDS TO BE AROUND ALL TRAILERS AND A SAFEY RAIL SYSTEM INSTALLED ON THE FENDERS OF THE TRAILERS....TO PREVENT THE WHEELS THAT ARE WIDER THAN THE TRAILER FROM RUNNING OVER YOU!!! NOBODY IS TAKING RESPONSIBILITY!!!!  Who is responsible to enure that SAFETY RULES ARE FOLLOWED?

A bill rejected by the state Legislature four years ago would have required a safety railing on parade floats  a measure that might have prevented the death of a 9-year-old boy in Portsmouth's holiday parade.
